About this Policy
We are Dosium Holdings Limited (company number: 12297188) (“Dosium”). We provide Hub (the “Software”), which is designed to view and quality assure medication data before it is used clinically in other Dosium solutions. Hub is intended for use by clinical professionals who are duly qualified and instructed (referred to as “you” or “Clinical End Users” throughout) to approve medication data prior to clinical use.
This Acceptable Use Policy (“AUP”) applies to all use of the Software [and any other services Dosium may offer]. We may update this AUP from time to time.
Acceptable Use
In order to keep our products and services running in a safe, secure and uninterrupted way, we need our users to agree not to misuse our Software. We therefore ask that you abide by this AUP by agreeing:
- not to use the Software for any purpose that is unlawful under any applicable law or prohibited by this AUP;
- not to use the Software to gain unauthorised access to or use of computers, data, systems, accounts or networks;
- where the Software is being used in organisations that are covered by NHS England guidance/obligations (excluding the Royal Pharmaceutical Society of Great Britain), to abide by the NHS England End User Organisation Acceptable Use Policy for use of NHS England Services that transact Personal Data which is accessible here, as may be updated from time to time during the Term by NHS England;
- that you have read and understood the Instructions for Use set out here (which may be updated from time to time), including any limitations of the Software identified therein (“Instructions for Use”) and fulfilled the Software training stipulated by the organisation within which you are using the Software (for example, your employer or relevant healthcare organisation from which you are accessing the Software);
- where necessary, to make the organisation within which you are using the Software aware that you have signed up to use the Software and follow any internal protocols or procedures set by that organisation;
- to check and use the Software regularly to ensure no updates or actions are missed;
- to use the Software only in a professional way and to use the Software for the intended use in relation to the intended purposes, as set out in the Instructions for Use;
- to safeguard access to any devices that you use to access the Software;
- to configure your device and your internet connection correctly in order to access the Software and use your own virus protection software;
- to maintain a secure and confidential password for your use of the Software and not to attempt to circumvent password or user authentication methods;
- not to share your unique login credentials with anyone else;
- to use an NHS approved domain name for your login email address when creating an account (e.g. nhs.net, nhs.uk or rpharms.com) (“Hub Account”) as these are the domains that we accept on the Software in accordance with the secure email standard (DCB1596);
- to inform us immediately if you suspect any unauthorised access to your Hub Account;
- to be responsible for all actions in your Hub Account;
- to ensure your Hub Account details are up to date, including the healthcare organisation that you are currently employed by and if these need updating, you agree to update your details by contacting support@dosium.com;
- to always provide accurate and complete information, for example accurate information in relation to the medication data you are reviewing and approving;
- to be responsible for all data you provide directly or indirectly via the Software (including all data you input in the course of reviewing and approving medication data) and any data derived from your use of the Software;
- not to do anything that infringes, misappropriates or violates our or any third party's intellectual property or other rights (such as privacy, publicity and other proprietary rights);
- not to use the Software for any commercial or financial gain;
- not to use the Software in a way that could damage, disable, overburden, or compromise in any way the confidentiality, integrity or availability of our systems;
- not to attempt to copy, modify, duplicate, create derivative works from, or otherwise change the whole or any part of the Software or attempt to decompile, disassemble or reverse engineer the Software; and
- not to attempt to access all or any part of the Software in order to build a product which competes with the Software.
Clinical Responsibility
You acknowledge and understand that the Software:
- is designed to assist in the assessment of dosing data and its accuracy relative to source material (the British National Formulary or other relevant clinical guideline), and which will be used to inform the care of patients. You remain at all times responsible for ensuring that any dosing information is assessed in accordance with your organisational procedures governing the use of medication data in Dosium software; and
- may, once approved by you within the Software, be relied upon by other Dosium solutions (including Touchdose) to generate dosing recommendations for use in the care of patients. You are therefore responsible for ensuring that any approval or rejection of medication data within the Software accurately reflects your professional assessment of that data against the relevant source material.
Any clinical data decisions made by you when using the Software, or any other services Dosium may offer, remain the responsibility of you alone, and Dosium shall not be liable for any outcomes resulting from the decisions made by you, whether or not such decisions were made with the assistance of the Software or any other services provided by Dosium.
Additional considerations
We are the owner or the licensee of all intellectual property rights in our Software, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
In order to identify any breaches of the above we will monitor the use of the Software for safeguarding purposes. We may also monitor the Software for usage rates. For more information on how we handle personal data, please see our Privacy Policy, which may be updated from time to time by us.
Without affecting any other remedies available to us, we may permanently or temporarily terminate [or suspend a user's account] or access to the Software and our services on notice if Dosium (in its sole discretion) determines that a user has violated this AUP. Please note that we are entitled to report any contraventions of this AUP to the Software licensee and/or any organisation by which you are employed or through whom you have gained access to the Software.
